Judge grants preliminary injunction hearing in lawsuit against SJSD’s reorganization plan

ST. JOSEPH, Mo. (KQTV)-- A local Circuit Court judge has granted a preliminary injunction hearing in a lawsuit filed by a local group that is trying to halt the St. Joseph School District's reorganization plan.

Circuit Court judge Kate Schaefer, 5th Judicial Circuit Court of Andrew and Buchanan County, will hear We The People - 3 Schools Inc.'s request for a preliminary injunction on Friday, May 29.

The "We the People- 3 Schools Inc.", a Missouri nonprofit corporation, has filed a lawsuit in Buchanan County Court, against the St. Joseph School District, the Board of Education and every current member of the board.

According to court documents, the 52-page lawsuit alleges that the SJSD Board of Education's "adoption of Plan 4BR is unconstitutional, unlawful, unreasonable, arbitrary, or capricious or involves an abuse of discretion under Section 536.150, RSMo."

The other count in the lawsuit alleges multiple Sunshine Law violations.

A preliminary injunction would halt SJSD's implementation of Plan 4BR while the lawsuit is ongoing.

The hearing is set for 1:30 p.m. on Friday, May 29, in Division 1 of the Buchanan County Circuit Court.
